Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tap2Detail ("Tap2Detail," "we," "us," or "our"). They govern your use of the Tap2Detail mobile apps, the website at app.tap2detail.com, and related services (together, the "Platform"). Please read them carefully.

ACCEPTANCE OF TERMS By creating an account, or by using the Platform, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Platform. When we publish a new version of these Terms, the Platform may ask you to review and agree to it before you continue. Our Cancellation Policy and Community Guidelines are part of these Terms. If you use the Platform as a detailer, the Provider Agreement also applies to you.

ELIGIBILITY You must be at least 18 years old and able to form a binding contract to use the Platform. You may not use the Platform if we have previously suspended or removed your account, or if using it would violate any law that applies to you. The Platform is currently offered in the United States.

CUSTOMER ACCOUNTS A customer (also called a requester) uses the Platform to request mobile car wash and detailing services for a vehicle. You are responsible for keeping your account information accurate and current, for keeping your sign-in credentials secure, and for all activity under your account. Tell us promptly at support@tap2detail.com if you believe your account has been used without your permission.

DETAILER ACCOUNTS Every new account starts as a customer account. A person or business who wants to offer services must submit a detailer application through the Platform. Tap2Detail reviews applications and decides, in its discretion, whether to approve them and which service types an approved detailer may offer. Approval does not mean Tap2Detail has verified a detailer's identity, licenses, permits, insurance, background or professional qualifications. Before receiving new work, an approved detailer must accept the Provider Agreement and complete payout setup with our payment processor.

MARKETPLACE / PLATFORM RELATIONSHIP Tap2Detail is a technology marketplace. It helps customers and independent detailers find each other, communicate about a job, and complete payment. Tap2Detail does not perform car wash or detailing services. The physical service is provided by the independent detailer who performs the job, and the service agreement for that job is between the customer and that detailer. Tap2Detail is not a party to that service agreement, except that we facilitate payment as described in these Terms.

INDEPENDENT SERVICE PROVIDERS Detailers are independent businesses or individuals. They are not employees, agents, joint venturers or partners of Tap2Detail. Detailers decide whether to make themselves available, which requests to respond to, and how they perform their services, subject to these Terms, the Provider Agreement and the law. Tap2Detail does not supervise or control the manner in which a detailer performs a service. Tap2Detail does not guarantee the quality, safety, timing or legality of any service, and does not guarantee customers any particular detailer or that a detailer will be available. Tap2Detail does not guarantee detailers any jobs, income or earnings.

SERVICE REQUESTS To request service, a customer chooses a service, a vehicle, a service location and an offered price, and may add notes and photos. The Platform may require a minimum price for a service and vehicle type, and requests may expire if no detailer is selected in time. You are responsible for the accuracy of the information in your request, including the vehicle, its condition and the service location.

JOB OFFERS AND ACCEPTANCE Eligible detailers near the service location can see a request (without its exact address) and may accept the customer's offered price, propose a counteroffer within the limits the Platform allows, or decline. Detailers are never required to respond to any request. The customer chooses which detailer to book. A job is booked only when the customer selects a detailer and the customer's payment authorization succeeds.

SERVICE PRICING Customers set the price they offer, at or above any minimum the Platform shows. Detailers may accept that price or propose a counteroffer within the Platform's limits. The service price for a job is the price agreed through this process. Before booking, the customer sees the service price, any Tap2Detail fee and the total.

TAP2DETAIL PLATFORM / SERVICE FEES Tap2Detail may charge customers a marketplace fee and may deduct a commission from the amount paid to detailers. The applicable customer fee is shown to the customer before booking, and the applicable commission and expected earnings are shown to the detailer before committing to a job. Fees for a job are fixed when the job is booked; later fee changes do not reprice booked jobs. We may change our fees for future jobs.

PAYMENT AUTHORIZATION / HOLDS When a customer books a detailer, the customer authorizes Tap2Detail, through our payment processor, to place a hold on the customer's payment method for the total shown. A hold is not a charge. Tap2Detail confirms the authorization with the payment processor on our own servers before the booking proceeds; the detailer receives the exact service address and private access notes only after that authorization succeeds. If the authorization fails, the job is not booked and you have not been charged.

PAYMENT CAPTURE The held amount is charged ("captured") only after the detailer marks the service finished and (a) the customer approves the completed service, (b) the review period shown in the app ends without the customer reporting a problem, or (c) Tap2Detail staff approve the charge after reviewing the job. A detailer cannot charge a customer by declaring a job finished. If a customer reports a problem during the review period, the charge is paused while Tap2Detail reviews it.

STRIPE / PAYMENT PROCESSING Payments and detailer payouts are processed by Stripe, Inc. and its affiliates ("Stripe"). By making or receiving payments through the Platform you also agree to Stripe's applicable terms, including the Stripe Connected Account Agreement for detailers. Tap2Detail does not store full card numbers. Payment methods are subject to approval by Stripe and your card issuer.

DETAILER PAYOUTS After a customer's payment is captured, the detailer's share (the service price and approved additional services, minus Tap2Detail's commission and any adjustments described in the Provider Agreement) is transferred to the detailer's connected Stripe account. Payout timing from Stripe to a detailer's bank account is set by Stripe. Payouts may be delayed, held or reversed in the case of refunds, disputes, suspected fraud or legal requirements.

CANCELLATIONS A customer may cancel a request free of charge before payment authorization. After a job is booked and payment is authorized, a cancellation request is reviewed by Tap2Detail staff, who decide whether the hold is released, or whether any amount is charged, based on the circumstances. Tap2Detail does not currently charge automatic cancellation fees. See the Cancellation Policy for details.

NO-SHOWS If a detailer does not arrive, or a customer or vehicle is not available at the service location, the affected user can report it through the Platform. Tap2Detail reviews no-show reports case by case. Tap2Detail does not currently charge automatic no-show fees.

REFUNDS Refunds are not automatic. If you believe you are entitled to a refund, report the problem through the Platform or contact support@tap2detail.com. Tap2Detail reviews refund requests and decides them in its reasonable discretion, considering the job record, photos, messages and both parties' accounts. Approved refunds are returned to the original payment method; your bank's processing time may vary. Nothing in these Terms limits any refund right you have under applicable law.

ADDITIONAL SERVICES / ADDITIONAL CHARGES During a job, a detailer may propose an additional service with a description and price. A detailer may not add any charge without the customer's approval, and may not ask the customer to pay outside the Platform.

CUSTOMER AUTHORIZATION FOR ADDITIONAL CHARGES If the customer approves a proposed additional service, the customer then authorizes a separate hold for that amount. Approval alone is not a payment. Approved additional services are charged together with the job under the capture rules in Section 12. If the customer declines, the detailer may not perform or charge for that service. Unresolved additional-service proposals must be resolved before the job can be completed.

VEHICLE ACCESS AND CUSTOMER RESPONSIBILITIES Customers must have the right to authorize service on the vehicle and at the service location, and must make sure the location is safe and lawful for mobile service (including any permission needed from a property owner, landlord or homeowners' association). Customers should remove valuables and personal items, give accurate access instructions, and be available as needed. Customers share an arrival code with the detailer in person to confirm arrival.

EXISTING VEHICLE / PROPERTY CONDITION Customers must disclose known conditions that could affect the service, such as existing damage, aftermarket parts, fragile finishes or leaks. Detailers are required to take before-service and after-service photos, which form part of the job record. Pre-existing damage or wear is not the responsibility of the detailer or Tap2Detail.

DAMAGE COMPLAINTS / CLAIMS If you believe your vehicle or property was damaged during a service, report it through the Platform as soon as possible, ideally during the review period and before the charge is captured, and include photos. Tap2Detail will review the job record and contact the detailer for a response. Responsibility for damage caused by a service rests with the detailer who performed it. Tap2Detail does not provide insurance, does not guarantee compensation, and is not liable for damage caused by a detailer, but may in its discretion facilitate communication, pause payment, issue refunds, or take action on an account.

CUSTOMER / DETAILER DISPUTES Disputes about a service are primarily between the customer and the detailer. Tap2Detail offers a support process to help resolve them and may make decisions about payment captures, refunds and account actions based on the information available. Tap2Detail's decisions in this process are not a determination of legal liability. If you dispute a charge with your card issuer, Tap2Detail and Stripe may provide the job record to the card issuer.

RATINGS AND REVIEWS After a completed job, a customer may leave one rating and review for the detailer. Reviews must be honest, based on the actual service, and must not include contact details, personal information, or prohibited content. Reviews cannot be edited or deleted by the user after posting. Tap2Detail may hide reviews that violate these Terms or the Community Guidelines. A detailer's average rating is shown publicly once enough reviews exist. Tap2Detail does not sell or pay for reviews.

PHOTOS AND USER-GENERATED CONTENT You keep ownership of content you submit, such as photos, notes, messages, profile information and reviews ("Your Content"). You grant Tap2Detail a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce and process Your Content as needed to operate, secure and improve the Platform and to resolve disputes. Request photos and before/after service photos are private to the job's customer, the assigned detailer and Tap2Detail staff; they are not posted publicly. Detailer portfolio and profile content is public by the detailer's choice. You must have the rights to anything you upload, and you must not upload content that is unlawful, infringing, sexual, hateful, harassing or that shows other people's private information without permission.

LOCATION INFORMATION The Platform uses location to match requests with nearby detailers, to show a detailer the service location, and to share a detailer's live location with the customer while the detailer is on the way or has arrived. Live location sharing happens only while the app is open and stops when the job leaves that stage. The exact service address is shared with the assigned detailer only after payment authorization. See the Privacy Policy.

ACCEPTABLE / PROHIBITED CONDUCT You agree not to: break any law; harass, threaten, discriminate against or endanger anyone; misrepresent your identity, business, vehicle or services; misuse another person's address, location or personal information; post fake or manipulated reviews; upload malware or attempt to interfere with or gain unauthorized access to the Platform; scrape or copy the Platform; create multiple accounts to evade restrictions; or use the Platform for any illegal or unsafe service. The Community Guidelines contain more detail.

FRAUD You may not use stolen or unauthorized payment methods, create false jobs, make false claims, manipulate prices, fees, reviews or payouts, or collude with another user to do so. Tap2Detail may hold or reverse payments, cancel jobs, report activity to Stripe or law enforcement, and suspend or terminate accounts involved in suspected fraud.

CIRCUMVENTING THE PLATFORM / OFF-PLATFORM TRANSACTIONS Users who meet through the Platform must not use it to arrange payment for a Platform job outside the Platform, or to share contact or payment details in requests, notes, profiles or reviews in order to avoid Platform fees. Payments made outside the Platform are not covered by Tap2Detail's payment, support or dispute processes. Repeated or serious circumvention may result in suspension or termination.

SUSPENSION AND TERMINATION Tap2Detail may suspend, restrict or terminate your account, or remove content, if we reasonably believe you violated these Terms, created risk for other users or Tap2Detail, or if required by law. Where appropriate we will tell you the reason and how to contact us. Suspension of a detailer may stop new work while existing obligations are resolved. You may stop using the Platform at any time.

ACCOUNT DELETION You can delete your account in the app under Account > Privacy & data > Delete account. Deletion may be blocked until active jobs, payments in progress, open support cases or evidence holds are resolved. When deletion completes, your sign-in account is deleted and your profile is anonymized. Some records, such as completed job history, payment records, legal acceptances, and safety and support records, are kept linked to an anonymous ID as needed for legal, tax, accounting, safety and dispute purposes, as described in the Privacy Policy. Deletion does not cancel obligations that arose before it.

INTELLECTUAL PROPERTY The Platform, including its software, design, text, graphics, logos and the Tap2Detail name, is owned by Tap2Detail or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Platform for its intended purpose under these Terms. You may not copy, modify, reverse engineer or use our trademarks without our written permission.

THIRD-PARTY SERVICES The Platform relies on third-party services, such as Stripe for payments, Google Maps and Apple Maps for maps and directions, Google and Apple for sign-in, and push-notification providers. Your use of those services may be subject to their own terms and privacy policies. Tap2Detail is not responsible for third-party services.

DISCLAIMERS THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, TAP2DETAIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. TAP2DETAIL DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, AND MAKES NO WARRANTY ABOUT ANY SERVICE PERFORMED BY A DETAILER OR ABOUT ANY USER'S CONDUCT, IDENTITY, LICENSING OR INSURANCE.

LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, TAP2DETAIL AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE PLATFORM OR ANY SERVICE PERFORMED BY A DETAILER. TAP2DETAIL'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE TAP2DETAIL FEES YOU PAID OR THAT WERE DEDUCTED FROM YOUR EARNINGS IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

INDEMNIFICATION To the extent permitted by law, you agree to defend, indemnify and hold harmless Tap2Detail and its owners, officers, employees and agents from claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or the law, Your Content, or, for detailers, the services you perform.

CHANGES TO THE SERVICE We may change, add or remove features of the Platform, or stop offering it in some or all areas, at any time. We will try to give reasonable notice of significant changes that affect booked jobs or pending payouts.

CHANGES TO THE TERMS We may update these Terms. Each version has a version number and effective date. If we make a material change, we will ask you to review and agree to the new version in the app before you continue using the Platform. Booked jobs remain subject to the version in effect when they were booked, unless the law requires otherwise.

GOVERNING LAW These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Platform will be brought in the state or federal courts located in Los Angeles County, California, and you and Tap2Detail consent to the jurisdiction of those courts, except that either party may bring an individual claim in small claims court where eligible. Before filing a claim, please contact us so we can try to resolve it informally.

GENERAL If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the documents they incorporate, are the entire agreement between you and Tap2Detail about the Platform.
